freshface natural soap provides services to you subject to the following conditions. If you visit or shop within this website, you accept these conditions. Please read them carefully. ​The terms and conditions apply to all the services and products provided by freshface natural soap (hereinafter referred to as «FFNS») to the customer and buyer, (hereinafter referred to as «customer»), and/or delivered and sold to the latter. Other contractual agreements shall only apply if they have been expressly agreed to in writing between FFNS and the customer. Any further or general contractual conditions in contradiction these terms and conditions are not binding in any way between FFNS and the customer. Individual agreements take precedence over these terms and conditions.
1. Disclaimer of liability
Disclaimer of warranties and limitation of liability this site is provided by FFNS on an «as is» and «as available» basis. FFNS makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your sole risk. To the full extent permissible by applicable law, FFNS disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. FFNS does not warrant that this site, its servers, or e-mail sent from FFNS are free of viruses or other harmful components. FFNS will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages. Certain country laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.
2. Intellectual property and copyright
FFNS uses the simplest and most authentic organic, high-quality vegan ingredients nature has to offer to get a step closer to our idea of the perfect soap: hand-made, organic, with a strikingly different design and refined recipes. FFNS is a registered Swiss trademark. All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of FFNS or its content suppliers and protected by international copyright laws. The compilation of all content on this site is the exclusive property of FFNS, with copyright authorship for this collection by FFNS, and protected by international copyright laws.
3. Electronic communication
When you visit the FFNS website or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
4. Availability
FFNS cannot guarantee availability of their full range of products at all times. If an item is not in stock, FFNS will inform the customer immediately after receipt of order, and state the possible delivery time.
5. Prices, terms of payment and default
Prices are in Swiss francs (CHF), valid on the day of order. The prices for the individual goods are stated in the respective presentation of each item. Unless otherwise agreed, payment for an individual order must be made in advance and shall fall due for payment immediately on completion of the order. The customer shall be billed electronically for the goods and services ordered, and invoices shall be sent to the email address they have specified. Unless otherwise agreed in writing, the invoice amounts are payable within 30 days of the invoice date at the latest. After the period of 30 days, the customer is in default. Subject to the registration of further rights, FFNS shall charge the customer default interest in the amount of CHF 10. The default occurs when the time limit is exceeded, without the need for a reminder.
6. Retention of title
Products are delivered subject to retention of title. The goods delivered shall remain the property pf freshface natural soap until such time as the purchase price has been paid in full.
7. ​Deliveries
The transport risk is transferred to the customer the moment the goods are handed over to the post office or parcel service, to the forwarding agent or carrier, but at the latest when they leave the production site of FFNS. The packaging and postage fees will be charged to the customer. Orders with a value over CHF 100 are delivered free of charge within Switzerland. Orders below CHF 100 will be sent by A-Post. The order is subject to the timely availability of goods. In case of non-availability of the goods, the customer will be informed by email immediately and any payments already made will be refunded, if the customer so wishes.
8. Delivery dates
Indicated delivery times are for guidance only. The customer is obliged to accept the delivered goods. If FFNS cannot fulfil their delivery obligations due to operational disruptions, lack of labour force, strike, failure to supply its own supplies, fire damage, military conflicts, official orders, significant changes in currency conditions or due to force majeure, it shall be released from its obligation to perform. The customer can only derive a claim for damages from delayed or late delivery if FFNS can be accused of intent or gross negligence. If FFNS should be obliged to pay damages, the amount of liability is limited to the net invoice value. Loss of profit, harm as a result of a defect and damages to third parties will not be compensated.
9. Right of withdrawal
Our concern is the satisfaction of all our customers. We strive to have all our products ready for delivery. If a product is sold out, the customer will be informed immediately by e-mail. At the request of the customer, the delivery will be adjusted, items back-ordered or cancelled.
The customer has the right to withdraw from contract within 14 days without stating any reason. The withdrawal period will expire after 14 days from the date of purchase or receipt the goods from the delivery service provider. To exercise the right of withdrawal, the customer must inform FFNS of their decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, or e-mail). The revocation period begins at the earliest upon receipt of these Terms and Conditions. The timely dispatch of the revocation or the goods is sufficient to comply with the revocation period. To meet the withdrawal deadline, it is sufficient for the customer to send their communication concerning their exercise of the right of withdrawal before the withdrawal period has expired.
10. Effects of withdrawal
If the customer withdraws from this contract, FFNS shall reimburse to them the payments received from the customer, without undue delay and in any event not later than 14 days from the day on which FFNS are informed about the customer’s decision to withdraw from this contract. FFNS will carry out such reimbursement using the same means of payment as the customer used for the initial transaction, unless the customer has expressly agreed otherwise; in any event, the customer will not incur any fees as a result of such reimbursement. FFNS may withhold reimbursement until receipt of the goods back or the customer has supplied evidence of having sent back the goods, whichever is the earliest.
The customer shall send back the goods or hand them over to FFNS without undue delay and in any event not later than 14 days from the day on which the customer communicates their withdrawal from this contract to FFNS. The deadline is met if the customer sends back the goods before the period of 14 days has expired. The customer will have to bear the direct cost of returning the goods. Opened packages, opened containers will not be taken back by FFNS. Essential oils, waxes, powders, electronic downloads, videos, tutorials, special requests made especially for the customer can also not be taken back by FFNS and are therefore not refundable. 11. Value added tax
FFNS is currently not subject to VAT according to Art. 21, Al. 1 of the Swiss VAT Act. Deliveries abroad may be subject to VAT and customs duties, which are charged to the customer.
12. Risk of loss
All items purchased from FFNS are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
13. ​Returns
Any defects must be reported to FFNS immediately, at the latest within 7 days, in letter form or by e-mail. The warranty period begins with the delivery to the customer’s indicated delivery address. FFNS is not liable for damage to the products after delivery due to non-compliance with the FFNS operating or care instructions. FFNS attempts to be as accurate as possible. However, FFNS does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by FFNS itself is not as described, your sole remedy is to return it in unused condition.
The customer is responsible for proving that the goods were defective at the time of delivery. If the customer asserts justified warranty claims, FFNS can either refund the purchase price or deliver replacement goods at their discretion. Further claims due to defective delivery, especially claims for damages including lost profits or other financial losses of the customer, are completely excluded, unless the cause of damage is based on intent or gross negligence of FFNS (cf. disclaimer of liability).
14. Data protection
Freshface natural soap attaches great importance to the protection and safety of the customer’s personal data. All the relevant information is contained in the Data Protection section on this website, as amended from time to time.
15. Applicable law
The Terms and Conditions and the legal relationship between FFNS and the customer are subject to Swiss law. Exclusive place of jurisdiction is the Canton of Zurich.
